Özellikle yüksek meblağlı idari para cezaları, lisans iptalleri ya da yayın durdurma gibi yaptırımlar, cezalandırıcı etki doğurmakta ve ceza hukukunun geleneksel sınırlarına temas etmektedir. Bu çalışmada, söz konusu yaptırımların kabahatler hukuku bağlamındaki hukuki mahiyeti ele alınmakta ve ceza hukukunun maddi ve usuli güvenceleri ile idari yaptırım rejimi arasındaki ilişki sistematik olarak değerlendirilmektedir. Rekabet Kurumu, RTÜK, SPK, BDDK ve KVKK gibi kurumların içtihatları ve ilgili sektör mevzuatına dayanarak yapılan çözümlemeler hem hukuki çerçevenin netleştirilmesini hem de uygulamada karşılaşılan sorunların görünür kılınmasını hedeflemektedir. Kolluk yetkisi kullanan idarenin ceza hukukuna yaklaşan yaptırımları karşısında piyasa aktörlerinin hangi güvencelere sahip olması gerektiği sorusuna normatif düzeyde ve uygulama temelinde verilen cevaplar, hukuk devleti ilkesiyle piyasa regülasyonu arasındaki dengeyi yeniden düşünmeyi gerekli kılmaktadır.
